Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cutaway service ("Cutaway", the "Service"), provided by Samavik L.L.C-FZ ("Samavik", "we", "us"), a company registered in the Meydan Free Zone, Dubai, United Arab Emirates. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Cutaway is a software service that processes raw skydiving video footage into edited, music-synced videos, stills, previews, and related delivery assets for dropzones and their customers. Features, functionality, and availability of the Service may change over time.

2. Eligibility and accounts

You must be able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to:

  • use the Service unlawfully or in breach of these Terms;
  • upload content you do not have the right to use, or that infringes the rights of others;
  • upload content that is unlawful, defamatory, or harmful;
  • attempt to disrupt, reverse engineer, or gain unauthorised access to the Service;
  • resell or commercially exploit the Service except as expressly permitted.

4. Your content and footage

You retain ownership of the footage and content you upload ("Your Content"). You grant us a limited licence to host, copy, process, edit, render, store, and deliver Your Content solely to provide the Service. You are responsible for obtaining all consents and permissions required from individuals appearing in Your Content, including tandem customers, and for ensuring you have the rights to any music, branding, or other material you supply or request.

5. Intellectual property

The Service, including its software, design, and branding, is owned by Samavik and protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as permitted here.

6. Fees and payment

Fees for the Service are as agreed between you and Samavik or as published. Unless stated otherwise, fees are exclusive of applicable taxes, including UAE VAT where it applies. Payment terms, billing cycles, and any refund or cancellation conditions are as set out in your order, subscription, or plan.

7. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue all or part of the Service, and will give reasonable notice of material changes where practicable.

8. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will meet your requirements or that output will be uninterrupted, timely, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Samavik will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, footage, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold Samavik harmless from claims arising out of Your Content, your use of the Service, or your breach of these Terms, including claims relating to consent of individuals appearing in Your Content or to music or other third-party material.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or comply with law. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

12. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. Disputes will be subject to the competent courts of Dubai, unless otherwise required by mandatory law.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance.
